He was hired to build the next generation of Google data centers. Instead, prosecutors say, he quietly copied a trove of confidential AI work and funneled it out of the company.

The man at the center of the case, identified in court filings as Ding, was sentenced by a federal judge to 12 months behind bars after a San Francisco jury found him guilty on multiple counts tied to the theft of trade secrets. The government had pushed for a far stiffer penalty, seeking 70 months to send a warning to Silicon Valley.

How 14,000 pages left the company

Google hired Ding in 2019 to help develop a new data center. Between spring 2022 and 2023, prosecutors say, he downloaded 1,255 internal documents — roughly 14,000 pages — and transferred them offsite. A jury convicted him on 14 counts that included stealing trade secrets and economic espionage; a judge later dropped the economic espionage charge, finding the evidence insufficient.

After serving his sentence, Ding will face two years of supervised release and repayment obligations. He must pay more than €184,000 to Google in restitution and an additional €2,300 fine. The court ordered him to report to authorities to begin his sentence within 90 days.

Why did prosecutors demand a longer term? Their message was blunt: an insider taking carefully gathered intellectual property is not a momentary lapse. "This was a calculated theft," an Assistant United States Attorney argued, saying the sentence should deter similar actions at other companies.

His lawyer pushed back. Grant Fondo told the court he understood public concern but asked judges to weigh the whole record, including his client’s ties and responsibilities to family. "History shows something different," Fondo said, arguing against a lengthy prison term.

The case exposes a persistent anxiety inside tech firms: the risk posed by trusted employees with broad access to proprietary work. It also highlights a legal balancing act. Prosecutors want to stop theft that could benefit foreign competitors. Judges must weigh evidence and intent before elevating charges to the level of espionage.

For Google and other AI-driven companies, the verdict will likely prompt renewed attention to internal safeguards. Access controls, monitoring and data-loss prevention systems were already priorities. Now those investments will be tested in courtrooms as well as server rooms.

Will stiffer criminal penalties change insider behavior? Maybe. But the broader challenge remains technical and cultural: how to protect cutting-edge research without turning workplace trust into suspicion.
